The Ohio Coalition to End Qualified Immunity (OCEQI) is taking bold action after exhausting legislative channels in the Ohio General Assembly.

The coalition is now advancing a citizen-led constitutional amendment to eliminate qualified immunity and other legal shields that prevent government accountability in Ohio.

The Solution: A Constitutional Amendment for Accountability

This initiative proposes a transformative amendment to the Ohio Constitution that would:

• Eliminate legal immunities for government actors, including qualified immunity, sovereign immunity, prosecutorial immunity, and judicial immunity.

• Empower citizens to sue government agencies—not individual employees—when their Ohio constitutional rights are violated, without needing to prove a “clearly established” right.

Key Provisions of the Amendment

• Accountability for Harm: Victims of government misconduct—such as excessive police force, judicial or prosecutorial abuse—can finally seek damages in court.

• Systemic Reform: Courts can mandate changes to prevent future abuses, addressing root causes instead of just individual incidents.

• Protection for Public Employees: Government workers would not be personally liable; the responsibility lies with the agency, preserving fairness while ensuring accountability.

• No Immunity Loopholes: Government actors would no longer be able to dismiss civil lawsuits based on statutory or judicial immunity doctrines.

The Path to the Ballot

• Signature Collection: OCEQI is gathering 443,000 valid signatures from registered Ohio voters by July 2026 to place the amendment on the November 2026 ballot.

• Citizen Power: This is a voter-led effort—bypassing the legislature—and putting power back in the hands of the people.

• Grassroots Campaign: The Coalition is mobilizing nonpartisan support across Ohio, sharing real stories where immunity blocked justice and accountability.

Why It Matters

Ohio could become the first state to end qualified immunity through a citizen-initiated constitutional amendment, following in the footsteps of states like Colorado and New Mexico that have already limited immunity through legislative action. If passed, this amendment would serve as a national model for restoring justice, transparency, and government responsibility—led by the people, for the people.
